TERMS OF SERVICE
Last updated: September 2026
OVERVIEW
This website and the Supersonics Piano services are operated by Supersonics Piano Pty Ltd. Throughout these Terms, “Supersonics Piano”, “we”, “us” and “our” refer to Supersonics Piano Pty Ltd.
These Terms of Service (“Terms”) apply when you visit our website, create an account, purchase a product, access a membership or subscription, or otherwise use any Supersonics Piano website, platform, content, product or service (collectively, the “Service”).
By using the Service, you agree to these Terms and to any additional terms or policies that are clearly identified as applying to a particular product or service. If you do not agree to these Terms, you should not use the Service.
Nothing in these Terms excludes, restricts or modifies any right, guarantee or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.
SECTION 1 – USING THE SERVICE
You must use the Service lawfully and in accordance with these Terms.
If you create an account, you are responsible for keeping your login details secure and for activity occurring through your account. You must not share account access except where your membership, studio account, school account or other plan expressly allows it.
If you are under the age required to enter into a contract in your place of residence, you may only use the Service with the permission and supervision of a parent, guardian or other person legally able to agree to these Terms on your behalf.
You must not interfere with the operation, security or availability of the Service, attempt to gain unauthorised access to any part of it, or use it in a way that may harm Supersonics Piano, other users or third parties.
SECTION 2 – ACCOUNTS, MEMBERSHIPS AND SUBSCRIPTIONS
Some parts of the Service require an account, membership or paid subscription.
The features, access rights, pricing, billing frequency, minimum term, renewal arrangements and cancellation conditions applying to a membership or subscription will be shown when you sign up or purchase the relevant service.
Where a subscription renews automatically, you authorise us and our payment providers to charge the applicable subscription fee using your nominated payment method at the stated billing interval until the subscription is cancelled or otherwise ends.
You are responsible for keeping your account, contact and payment information current and accurate.
If a payment fails, expires or is declined, we may temporarily suspend paid access while the payment issue is resolved.
Where we change the price of an ongoing subscription, the new price will apply only to future billing periods after reasonable notice has been given. Price changes will not retrospectively alter payments already made.
Membership and subscription access is personal to the account holder or authorised users covered by the relevant account type. Accounts, memberships and subscriptions must not be transferred, resold or shared beyond the users permitted by the relevant plan.
SECTION 3 – PRODUCTS, ORDERS AND PAYMENTS
Prices and product information are displayed on the relevant product or checkout page. Prices may change from time to time, but a price change will not alter an order that we have already accepted unless required by law or agreed with you.
We may refuse or cancel an order where there is a genuine pricing or listing error, suspected fraud, unauthorised payment, product unavailability, misuse of the Service or another reasonable basis for doing so.
If we cancel an order after payment has been taken and the relevant product or service has not been supplied, we will refund the amount paid for that product or service.
You agree to provide accurate billing, contact and account information when making purchases.
Physical products are subject to the shipping, delivery and returns conditions described in our Shipping and Returns Policy.
View our Shipping and Returns Policy.
Digital products are supplied electronically and may be subject to specific licence conditions described on the relevant product page, download page or elsewhere in the Service.
SECTION 4 – DIGITAL CONTENT AND LICENCES
Purchasing or accessing Supersonics Piano content does not transfer ownership of the copyright or other intellectual property in that content to you.
Unless a different licence is expressly provided, products and content are supplied for personal, educational or studio use in accordance with the licence associated with your purchase, membership or account type.
You may not reproduce, distribute, upload, publish, sell, sublicense, share or otherwise make Supersonics Piano content available to others except where expressly permitted by the applicable licence or by law.
A studio, school, teacher or other multi-user licence applies only to the users and uses permitted under that licence. Access must not be extended to additional users simply by sharing files, passwords, account details or download links.
Where content is streamed or made available as part of a membership rather than purchased as a permanent download, your right to access that content may end when the relevant membership or entitlement ends.
Any licence supplied with an individual product, book, resource, membership or other service forms part of these Terms for your use of that material.
SECTION 5 – INTELLECTUAL PROPERTY
Unless otherwise stated, the Service and its content are owned by, licensed to, or used with permission by Supersonics Piano Pty Ltd and/or the relevant copyright owner.
This includes musical compositions, sheet music, scores, books, downloadable files, recordings, audio, video, MIDI files, MusicXML files, teaching materials, exercises, backing tracks, text, graphics, images, website content, software, databases and other original material.
Copyright in compositions and other material by Daniel McFarlane remains owned or controlled by Daniel McFarlane and/or Supersonics Piano Pty Ltd unless otherwise stated.
The names, logos, branding, product names and other identifiers used by Supersonics Piano may also be protected by trade mark, passing off, consumer protection and other applicable laws.
Nothing in these Terms gives you ownership of, or a general licence to use, any Supersonics Piano or Daniel McFarlane name, logo, trade mark, copyright work or other intellectual property except for the limited use expressly permitted by your purchase, membership or these Terms.
You must not represent that any product, composition, recording, service or other material created by you or by a third party was created, authorised, endorsed or supplied by Daniel McFarlane or Supersonics Piano unless we have expressly agreed to that representation in writing.
SECTION 6 – ARTIFICIAL INTELLIGENCE AND AUTOMATED USE
Supersonics Piano content is not licensed for artificial intelligence or machine learning training, model development or similar uses unless we have given prior written permission.
Without our prior written permission, you must not use, reproduce, download, scrape, crawl, extract, collect, analyse or otherwise obtain content from the Service for the purpose of:
(a) training, fine-tuning, developing, grounding, testing, evaluating, benchmarking or improving an artificial intelligence, machine learning, generative AI or similar computational system;
(b) creating or contributing to a dataset, corpus, embedding, model, retrieval system or other collection used for artificial intelligence or machine learning purposes;
(c) extracting musical, textual, audiovisual or other features for use in artificial intelligence or machine learning development;
(d) developing or enabling a system intended to imitate, simulate or generate material based on Supersonics Piano content or compositions by Daniel McFarlane; or
(e) developing, supplying or improving a service designed to generate musical, educational, textual, visual or other content specifically imitating material created by Daniel McFarlane or Supersonics Piano.
These restrictions apply to musical compositions, sheet music, scores, recordings, audio, video, MIDI files, MusicXML files, text, teaching materials, images, metadata and other content made available through the Service.
Making content publicly accessible through our website, social media accounts, video platforms or other online services does not constitute permission to use that content for artificial intelligence or machine learning training, development or datasets.
Nothing in these Terms grants permission to use the names “Daniel McFarlane” or “Supersonics Piano”, or our branding or other identifiers, to label, attribute, advertise or market AI-generated material in a way that suggests that material was created, supplied, authorised, endorsed or approved by us.
Ordinary indexing by general-purpose search engines for the purpose of displaying search results is not prohibited by this section where that indexing complies with our technical instructions and is not used for artificial intelligence or machine learning training or model development.
Requests to license Supersonics Piano or Daniel McFarlane content for artificial intelligence, machine learning or related uses must be made in writing to support@supersonicspiano.com.
SECTION 7 – PROHIBITED USES
You must not use the Service or its content:
(a) for an unlawful or fraudulent purpose;
(b) in a way that infringes our intellectual property rights or the rights of another person;
(c) to distribute viruses, malware, malicious code or other material intended to interfere with computer systems or networks;
(d) to gain or attempt to gain unauthorised access to accounts, systems, content or data;
(e) to collect personal information about other users without lawful authority;
(f) to bypass access controls, download restrictions, membership restrictions or other security measures;
(g) to resell, redistribute or commercially exploit the Service or its content except where expressly permitted;
(h) to share passwords, account credentials, download links or protected content with unauthorised users;
(i) to carry out scraping, crawling, automated extraction or other automated activity prohibited by Section 6; or
(j) to use the Service in a manner that materially interferes with its operation or the ability of other users to access it.
We may take reasonable steps to prevent or stop prohibited use, including restricting automated systems, suspending accounts, terminating access or taking other appropriate action.
SECTION 8 – THIRD-PARTY SERVICES AND LINKS
The Service may use or link to third-party platforms, payment providers, video services, software, websites or other services.
Those third-party services may have their own terms, privacy policies and operating conditions. We are not responsible for the content, availability, security or practices of third-party services that we do not control.
Where a third-party service is necessary for us to provide something you have purchased from us, this section does not limit any responsibility we have under applicable law for providing that product or service.
SECTION 9 – COMMENTS, FEEDBACK AND SUBMISSIONS
If you send us feedback, suggestions, comments, reviews or other communications, you remain responsible for the content you submit and must not knowingly infringe the rights of another person.
You give us permission to use ordinary feedback, reviews and suggestions for the reasonable purposes of operating, improving and promoting Supersonics Piano, unless we have agreed otherwise with you.
Submitting material to us does not transfer ownership of your copyright or other intellectual property unless we separately agree to that in writing.
We may remove material submitted through the Service where we reasonably believe it is unlawful, infringes another person’s rights, is harmful to the Service or breaches these Terms.
SECTION 10 – PRIVACY
Our collection and handling of personal information is governed by our Privacy Policy.
View our Privacy Policy.
Payment information may be processed by third-party payment providers. We do not necessarily receive or store complete payment card details ourselves.
SECTION 11 – AVAILABILITY AND CHANGES TO THE SERVICE
We may update, improve, replace or discontinue parts of the Service from time to time.
We do not guarantee that every feature or item of content will remain available indefinitely. Where a material change affects a paid product, membership or service, we will act reasonably and consistently with any rights you have under the Australian Consumer Law or other applicable law.
The Service may occasionally be unavailable because of maintenance, technical problems, third-party outages or circumstances beyond our reasonable control.
We will take reasonable steps to correct significant errors in information, pricing or operation when they come to our attention.
SECTION 12 – SHIPPING, RETURNS, REFUNDS AND CONSUMER RIGHTS
Our products and services come with rights and guarantees that may apply under the Australian Consumer Law and other applicable consumer protection laws. These rights cannot be excluded by these Terms.
Where a product or service does not meet an applicable consumer guarantee, you may be entitled to a repair, replacement, refund, cancellation, compensation or another remedy depending on the circumstances and applicable law.
Our Shipping and Returns Policy provides additional information about shipping, delivery, damaged or missing orders, returns, refunds and change-of-mind requests.
That policy operates in addition to, and does not replace or limit, any rights you have under applicable consumer law.
View our Shipping and Returns Policy.
SECTION 13 – WARRANTIES AND LIABILITY
Nothing in this section excludes, restricts or modifies any consumer guarantee, statutory right or other liability that cannot lawfully be excluded, restricted or modified.
Subject to those rights, we do not guarantee that the Service will always be uninterrupted, error-free or compatible with every device, browser, operating system or third-party service.
Information, resources and educational material provided through the Service are supplied for their stated purposes. You remain responsible for deciding how they are used in your own teaching, study, performance or other activities.
To the maximum extent permitted by law, we are not liable for indirect or consequential loss that was not reasonably foreseeable or that results from circumstances outside our reasonable control.
Nothing in these Terms limits liability for fraud, wilful misconduct or any other liability that cannot legally be limited.
SECTION 14 – RESPONSIBILITY FOR BREACHES
You are responsible for loss or damage reasonably suffered by us as a direct result of your unlawful conduct, infringement of our intellectual property rights, or material breach of these Terms, to the extent that you caused or contributed to that loss.
This section does not require you to compensate us for loss caused by our own acts or omissions, or for amounts that cannot lawfully be recovered from you.
SECTION 15 – SUSPENSION AND TERMINATION
You may stop using the Service at any time. Memberships and subscriptions may be cancelled in accordance with the conditions applying to the relevant plan.
We may suspend or terminate access where we reasonably believe that an account has been used fraudulently, unlawfully, in breach of these Terms, to infringe intellectual property rights, to compromise the security of the Service, or in another way that creates a material risk to us or other users.
Where appropriate, we may give you an opportunity to correct a breach before terminating access. We may act immediately where the breach is serious, deliberate, unlawful or creates an urgent security or intellectual property risk.
Termination does not affect rights or obligations that arose before termination. Provisions relating to intellectual property, artificial intelligence, liability and other matters that by their nature are intended to continue will survive termination.
SECTION 16 – CHANGES TO THESE TERMS
We may update these Terms when reasonably necessary, including to reflect changes to the Service, our business practices, technology or applicable law.
The current version will be published on this page with the date of the latest update.
Where a change materially affects an ongoing paid service, we will provide reasonable notice where practicable. We will not use a change to these Terms to retrospectively remove rights that you have already acquired under a completed purchase or under applicable law.
Your continued use of the Service after updated Terms take effect constitutes acceptance of the updated Terms to the extent permitted by law.
SECTION 17 – GOVERNING LAW
These Terms are governed by the laws of Queensland, Australia.
Subject to any rights you have under applicable consumer law, the parties submit to the jurisdiction of the courts of Queensland and courts entitled to hear appeals from those courts.
If you live outside Australia, you may also have rights under mandatory laws that apply in your place of residence. Nothing in these Terms is intended to exclude rights that cannot legally be excluded.
SECTION 18 – GENERAL
If part of these Terms is found to be invalid or unenforceable, that part will be interpreted or severed to the minimum extent necessary and the remaining Terms will continue to apply.
If we do not immediately enforce a provision of these Terms, that does not mean we have waived our right to enforce it later.
These Terms, together with any product-specific licence, membership conditions, Privacy Policy, Shipping and Returns Policy and other policies expressly incorporated into them, form the agreement governing your use of the Service.
Where a particular product or service has specific terms that conflict with these general Terms, the specific terms apply to that product or service to the extent of the conflict.
